Recovery

Pursuit of carriers, forwarders and terminals where the evidence supports a recourse. Service 16 — After the loss.

When you instruct one.

  • A survey has established that somebody else caused the loss.
  • You have paid a claim and the right of subrogation is yours to use.
  • Time bars are running and a recourse has to be protected now.
  • The responsible party is in a jurisdiction you cannot easily reach.

What we do.

  • 01Confirm the recourse is real. Before spending money on it — and saying so when it is not.
  • 02Protect the time bar. Extensions sought, or proceedings issued, before the date rather than after it.
  • 03Put the claim. With the evidence attached, to the party actually liable under the contract of carriage.
  • 04Negotiate. Against the convention limits that apply, not against a hoped-for figure.
  • 05Escalate where it is worth it. Including arrest, where security is the only thing that will move the file.

What you receive.

  • A recoverability assessment before any cost is incurred.
  • Time bar protection, with the dates recorded.
  • The claim presented and negotiated on your behalf.
  • A settlement recommendation, or a reasoned recommendation to stop.

What we need from you

  • The survey report and the evidence file
  • The contract of carriage and the bill of lading
  • Proof of your payment and subrogation, where insured
  • Your authority limits

What we hold ourselves to

  • 2–24hA surveyor instructed from the network nearest the cargo.
  • 24–48hYour update on the appraisal, with photographs and the key information.
  • 72hThe detailed preliminary report, after the survey assessment.
  • 45 daysExpected turnover per mission. The final report follows the loss mitigation or destruction operation.

Attendance on site depends on distance to the port and on terminal and customs access, so that is confirmed on your file rather than promised as one number for every port on the continent.
